1. Service Description

LinguaLive ("the Service") is a real-time voice translation software-as-a-service (SaaS) platform operated by RIALD ("we," "us," or "our"). The Service enables users to join virtual rooms, speak into their device microphone, and receive real-time transcriptions and translations of spoken content into multiple languages. The Service is accessible at translate3.riald.info and through any associated subdomains or applications.

2. Account Terms

By creating an account and using the Service, you agree to the following:

  • You must be at least 18 years of age, or the age of legal majority in your jurisdiction, to use this Service.
  • You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
  • You must provide accurate and complete information when creating your account and keep that information up to date.
  • You must notify us immediately at support@riald.info if you become aware of any unauthorized use of your account.
  • One person or legal entity may not maintain more than one account. Shared or team accounts are managed through the organization feature.

3. Acceptable Use

You agree not to use the Service in any manner that:

  • Violates any applicable local, state, national, or international law or regulation.
  • Transmits any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable.
  • Abuses, overloads, or interferes with the Service's infrastructure, APIs, or the experience of other users.
  • Attempts to reverse engineer, decompile, disassemble, or otherwise derive the source code or underlying algorithms of the Service.
  • Uses automated scripts, bots, or crawlers to access or scrape the Service without our prior written consent.
  • Impersonates any person or entity, or falsely represents your affiliation with any person or entity.
  • Records, stores, or redistributes audio, transcriptions, or translations of other users without their explicit consent.

We reserve the right to investigate and take appropriate action against anyone who, in our sole discretion, violates this provision, including without limitation removing content, suspending or terminating the offending user's account, and reporting them to law enforcement authorities.

4. Payment Terms

  • Certain features of the Service require a paid subscription. Pricing details are available on our Pricing page.
  • All payments are processed securely through Stripe. By subscribing to a paid plan, you agree to Stripe's Terms of Service.
  • Subscriptions are billed on a recurring monthly or annual basis, depending on the plan selected. Your subscription will automatically renew at the end of each billing period unless you cancel before the renewal date.
  • You may cancel your subscription at any time through your account settings or by contacting us. Cancellation takes effect at the end of the current billing period. No prorated refunds are issued for partial billing periods.
  • We reserve the right to change our pricing with 30 days' advance notice. Continued use of the Service after a price change constitutes acceptance of the new pricing.
  • If payment fails, we may suspend access to paid features until the outstanding balance is resolved.

5. Intellectual Property

Your Content: You retain all rights to the audio, transcriptions, translations, and any other content you generate through the Service ("User Content"). By using the Service, you grant us a limited, non-exclusive license to process your User Content solely for the purpose of providing and improving the Service.

Our Service: The Service, including its design, code, algorithms, user interface, documentation, and all related intellectual property, is and remains the exclusive property of RIALD. Nothing in these Terms grants you any right, title, or interest in the Service beyond the limited right to use it in accordance with these Terms. The LinguaLive name, logo, and all related trademarks are the property of RIALD.

6. Data & Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, store, and protect your information. By using the Service, you acknowledge that you have read and understood our Privacy Policy and consent to the practices described therein. Audio data is processed in real time for transcription and is not permanently stored on our servers. Transcriptions and translations are retained according to your organization's plan-specific retention policy.

7. Service Availability

We strive to maintain high availability of the Service, but we do not guarantee uninterrupted or error-free operation. The Service is provided on an "as is" and "as available" basis. We may experience downtime due to maintenance, updates, third-party service outages (including Google Cloud and Firebase), or circumstances beyond our reasonable control. We will make reasonable efforts to notify users of planned maintenance in advance. We do not offer a formal Service Level Agreement (SLA) unless separately agreed upon in writing for Enterprise customers.

8. Termination

By You: You may stop using the Service and cancel your account at any time by contacting us at support@riald.info or through your account settings. Upon cancellation, your data will be retained for the period specified in our Privacy Policy before being permanently deleted.

By Us: We reserve the right to suspend or terminate your account and access to the Service, with or without notice, if we reasonably believe that you have violated these Terms, engaged in fraudulent or illegal activity, or if your use of the Service poses a risk to other users or our infrastructure. In the event of termination for cause, no refund of prepaid fees will be issued.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL RIALD, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • Your access to, use of, or inability to access or use the Service.
  • Any conduct or content of any third party on the Service.
  • Any content obtained from the Service, including any errors or omissions in transcriptions or translations.
  • Unauthorized access, use, or alteration of your transmissions or content.

OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED U.S. DOLLARS ($100), WHICHEVER IS GREATER.

The Service relies on machine learning models for transcription and translation. While we strive for accuracy, we do not guarantee that transcriptions or translations will be error-free. The Service should not be relied upon as the sole source of record for critical, legal, or medical communications.

10. Changes to Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will update the "Last updated" date at the top of this page and, where practicable, notify you via email or through a notice within the Service. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the Service and cancel your account.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States of America, without regard to its conflict of law provisions. Any legal action or proceeding arising out of or relating to these Terms or the Service shall be brought exclusively in the federal or state courts located in the State of Delaware, and you consent to the personal jurisdiction of such courts.
